QCAT Matters

Why engage Sheehan & Co to provide advice on a matter before the Queensland Civil and Administrative Tribunal (QCAT)?

QCAT was established in 2010 to amalgamate the numerous consumer tribunals which handled various matters.

QCAT is a consumer friendly tribunal aimed to resolve disputes in a quick and cost effective manner. The matters which QCAT can determine are wide and include:

  • Building disputes;
  • Debt disputes;
  • Minor civil disputes;
  • Consumer disputes;
  • Residential tenancy disputes;
  • Retail shop lease disputes;
  • Dividing fence and tree disputes;
  • Occupational regulation matters;
  • Administrative matters;
  • Anti-discrimination matters;
  • Administrative and guardianship matters for adults;
  • Children and young people matters; and
  • Other civil disputes.

Sheehan & Co can advise you on various QCAT matters and will guide you through the process.

In some circumstances, legal representation before QCAT is limited (particularly in relation to minor debt disputes). However, this does not prevent you from obtaining legal advice prior to the QCAT hearing so that you can properly prepare for the hearing (including preparation of QCAT documentation).

QCAT can be a quick and cost effective method of resolving a dispute but care should be taken to ensure that QCAT has jurisdiction in your matter so as to avoid unnecessary delays and the potential of your matter being dismissed.

Our services in this area are tailored to achieve better outcomes for you by:

  • Providing you with clear and up-to-date advice regarding the QCAT process from the filing of an Application to the final determination of your matter;
  • Providing you with advice on whether QCAT is the correct jurisdiction to hear your matter;
  • Drafting and preparing your QCAT documents, including Applications, Affidavits and Submissions; and
  • If permitted, appearing on your behalf at a QCAT mediation or hearing.
