Divorce & Separation
Why engage Sheehan & Co to act on your behalf in relation to your divorce application?
Provided you have been living apart from your spouse either physically or under the one roof for a period of 12 months, you are entitled to apply for a divorce.
You will be granted a decree nisi (divorce) from the Court provided the Court is satisfied that there has been a total breakdown of the marriage (that is, reconciliation is not feasible).
Sheehan &Co's experienced team of family lawyers led by Michele Sheehan, Queensland Law Society Family Law Accredited Specialist, can assist you in preparing and filing the necessary documents to ensure that the process is as stress-free for you as possible.
Alternatively, self-help Option
We recommend to people that they can act on their own behalf in preparing and filing their divorce application if they feel comfortable about pursuing this option. The Federal Circuit Court of Australia has released an Application for Divorce Kit which can be downloaded in various formats on its website (available here).
Property settlement and spousal maintenance proceedings must be commenced within 1 year of the divorce being granted. There are strict time limits which must be complied with for the filing of the divorce application. If you wish to file an application for property settlement and/or spousal maintenance proceedings after the 1 year period, application will need to be made to the Court granting you leave to commence those proceedings. There is no certainty that such an order will be granted.
